  Judgement
Hon.ble Rajiv Sharma, J.: Heard Mr. Bhavesh, learned Counsel for the petitioner and Mr. Sanjay Sarin, learned Standing Counsel. This petition is directed against the order of transfer dated 19.6.2009 passed by the opposite party No.2 whereby the petitioner has been transferred from the Community Health Centre, Nawabganj, Gonda to Primary Health Centre, Rupaideeh, District Gonda. The petitioner has already made a representation to the authorities narrating his difficulties in proceeding on transfer. In view of the law laid down by the Apex Court in the case of Mrs. Shilpi Bose v. State of Bihar and others [AIR 1991 SC 531], I am not inclined to interfere under Article 226 of the Constitution of India. However, I direct the Director, Medical & Health Services, Lucknow/opposite party No.3 to dispose of the representation, copy of which is enclosed as Annexure No.3 to the writ petition, in accordance with law, expeditiously, preferably by 31.8.2009, if the same has not yet been decided. With the above directions, the writ petition is disposed of finally.
